The following list is an example of cases we have litigated in the past. We do not guarantee results in any case.
 
Bankruptcy:

We helped a young mother obtain an adversarial judgment in the United States Bankruptcy Court against a national collection agency for its use of unfair collection practices against our client during her bankruptcy. Hamann v. National Check Control


Criminal Law:

We represented a young man accused of stabbing an individual at a house party. He was found not guilty after trial to a jury where it was proven he was acting in self-defense. State v. Brown


We defended a young man charged with forgery involving a series of events which were actually committed by others. A Codington County Jury found him not guilty. State v. Freese


Employment Law:

We represented an insurance agent who was denied commissions that he was entitled to pursuant to an employee handbook. A fellow insurance agent had sold insurance products to our client's customers but refused to follow the employee handbook on splitting commissions. At trial, our client was awarded the commission to which he was entitled. Although the South Dakota Supreme Court reduced the damage award on appeal, it upheld the basic issue advanced by our client that provisions in an employee handbook can constitute a contract and must be followed by employees. Family Law:

We represented a father seeking visitation rights over his twin daughters who was falsely accused of abusing them. After two appeals to the South Dakota Supreme Court, the father's visitation rights were upheld and he was awarded reimbursement of attorney fees. Toft v. Toft, et al


Personal Injury/Insurance Disputes:

Our office represented a mother and her disabled child who were seriously injured when the other driver failed to yield the right-away and pulled out in front of our clients. The insurance company initially denied our clients' claim but we eventually negotiated an acceptable settlement on their behalf. Edwards v. Sterling Wheeler et al


We helped an elderly woman who was injured in a parking lot at a local restaurant when she fell in an unmarked construction hole. We were able to negotiate a settlement on her behalf. Borns v. M.C. Hartshorn, Inc. et al


Social Security Appeals:

We assisted a client in obtaining disability benefits, which were denied three times after she had suffered a severe mental breakdown following the death of several close family members and other mental health issues.


Workers' Compensation:

We represented a working wife and mother who injured her back while at work. After an appeal from the Administrative Law Judge to the Circuit Court, our client won and was awarded a substantial benefit. The case was settled to our client's satisfaction while an appeal was pending to the South Dakota Supreme Court. Larson v. Otter Tail Power Company
